Please read these Terms of Service (“Terms”) carefully before using the viabolat.com website (the “Service”) operated by viabolat (“we”, “us”, or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
1. Scope of Services
viabolat provides professional diagnostic, analysis, and automation-related services, including but not limited to data diagnostics, workflow assessments, and technical evaluations (“Services”).
Services are provided on a fixed-scope, fixed-fee basis unless otherwise agreed in writing. The Service does not include subscriptions, user accounts, or ongoing platform access.
2. Diagnostic Services Disclaimer
Diagnostic engagements are analytical and advisory in nature. You acknowledge and agree that:
- Diagnostics are based on the data, systems, and access you provide
- Findings may identify issues, risks, inefficiencies, or confirm that no corrective action is required
- No specific fix, outcome, or improvement is guaranteed
Payment is for professional time, expertise, and analysis — not for implementation or results.
3. Client Responsibilities
You are responsible for ensuring that any data, systems, or materials provided:
- Are accurate and complete
- Are lawfully owned or authorized for review
- Do not violate third-party rights or agreements
viabolat is not responsible for conclusions or recommendations impacted by incomplete, inaccurate, or misleading information.
4. Payments and Refunds
Fees for diagnostic services are due in full prior to the start of any work, unless otherwise agreed in writing.
Diagnostic engagements are professional analysis services billed for time, expertise, and evaluation.
- All diagnostic fees are non-refundable once the diagnostic report has been delivered
- No refunds will be issued based on disagreement with findings, outcomes, or recommendations
- No refunds will be issued if the client chooses to implement the recommendations independently or resolves issues without further assistance
The diagnostic engagement is considered complete upon delivery of the written report, whether provided as a PDF, document, dashboard export, or other written format.
5. Implementation and Follow-Up Work
Implementation, tooling, or automation builds are not included in diagnostic services unless explicitly agreed in writing.
Any follow-up work is subject to separate scope, pricing, and agreement.
6. Intellectual Property
Unless otherwise agreed in writing:
- Clients may use delivered reports internally
- viabolat retains ownership of methodologies, templates, tools, and processes
No transfer of intellectual property rights is implied beyond internal use of delivered materials.
7. Limitation of Liability
To the maximum extent permitted by law, viabolat shall not be liable for any indirect, incidental, special, or consequential damages.
viabolat’s total liability shall not exceed the amount paid for the specific service giving rise to the claim.
8. Third-Party Links
The Service may contain links to third-party websites or services not owned or controlled by viabolat. We assume no responsibility for their content or practices.
9. Termination
We may suspend or terminate access to the Service at any time if these Terms are violated. Provisions which by their nature should survive termination shall survive.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of Romania, without regard to its conflict of law provisions.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. Continued use of the Service constitutes acceptance of revised Terms.
